Gender-based pay discrimination is illegal

The wage gap is a much-debated topic in the U.S., with many justifying it or even outright denying its existence. According to the U.S. Bureau of Labor Statistics, full-time female workers in Colorado in 2020 only earned 78.1% of their male counterparts’ average weekly pay.

Due to the stigma around and discouragement from management about discussing wages, many women do not realize their employers pay them less for the same jobs male coworkers perform. Many also do not know that this is actually against the law.

The Equal Pay Act

The 1963 federal Equal Pay Act officially made it illegal for employers to pay people less for the same position involving the same skills, tasks and responsibilities based on gender. It also prohibits other gender-based work discrimination. Under this act, individuals who feel that they are victims of unfair practices in their workplace because of sex have the right to file a complaint with the Equal Employment Opportunity Commission.

The Equal Pay for Equal Work Act

In 2021, Colorado’s Equal Pay for Equal Work Act officially came into play. This law puts into place policies protecting workers from repercussions for discussing pay, banning employers from asking potential employees about their previous wages and forcing companies to list salary ranges in job postings, and providing information about internal job opportunities and promotions to all workers on the same day.

While the wage gap persists, it also continues to close. There exist laws to protect both women and men from workplace gender discrimination, including wage inequities. Those suffering from pay discrimination because of their sex have options.
